Settlement agreements usually arise when your employer wishes to end your employment without any risk of being sued. They can also be used in redundancy situations where you would usually be offered above your basic redundancy entitlement in exchange for waiving certain rights.
 
Settlement agreements stipulate that you must receive independent legal advice on the terms of the agreement before signing, to ensure that you are clear on the impact of signing the agreement including giving up any pre-existing rights. Your employer will usually be responsible for contributing towards the cost of your legal advice.
